      <image:caption>Many years ago, after completing my law degree in the early 90’s, I ran into a practicing mediator at an ADR course and he offered me a small piece of very valuable advice, which was to go off and get some more life experience before attempting mediation, so that I could better relate to my client’s perspectives from real world experience. So that’s what I did …………. for about 30 years. Recently I connected back up with that same mediator from years ago, and out of our discussions I realised that even though I had not been formally practicing as a mediator, I had actually been continually using my mediation communication skills within the multiple senior business roles I have held over the last three decades. What this means for my clients is that I bring a very pragmatic and practical approach to my mediations. I have sound knowledge of the law, but I am not overly influenced by an adversarial, win/lose, mindset and I can therefore serve the collaborative intent of mediation very effectively. I have also developed in-depth business knowledge to understand many of the underlying interests in commercial and employment disputes, including partnership dissolutions .</image:caption>

      <image:caption>A classic statement from “Getting to yes” proposes that: disputing parties usually assume that because they have opposing positions in the dispute, then all of their underlying interests are also opposed. This is not usually true, as there are normally many interests in the background of a dispute that the parties have not talked about, some will be neutral to both parties and there may even be common shared mutual interests.
